A trucker from Tennessee was arrested after he traveled to Georgia to meet what he thought was an under aged child. According to authorities Seth Weidemann used the internet to try to exploit a vulnerable child for sexual gratification. According to authorities Weidemann began communicating with an undercover agent in January of 2019, thinking he was talking to an 11-year-old girl. Weidemann sent multiple messages trying to meet with the minor for sex. Unbeknownst to him, he was setting himself up for a trap, a sting if you will. Weidemann at one point was sending explicit messages describing what he wanted to do with the intended minor. Little did he know his disgusting low life massages were being recorded and as the Miranda rights quotes "Anything you say may be used against you in a court of law." and what you write on the internet is just like saying it. On February 14, 2019, Weidemann traveled to the Atlanta area for a meeting with the child and was immediately arrested by FBI agents lying in wait for him! Sentencing Weidemann was sentenced to 17 years in prison, followed by 10 years of supervised release. Officials say Weidemann had been convicted on October 16, 2019, after he pleaded guilty to one count of attempted coercion and enticement of a minor. A truck driver is in prison and a dock manager is dead. That was the result of an impatient trucker trying to get unloaded before his appointment. Truck driver Timothy Saunders got into an argument with Thomas Hartman in May of 2019 and it would change their lives forever. The result was Saunders pointing a gun at Hartman and pulling the trigger. One family has lost a member forever and another family will have to watch their loved one grow very old behind bars. This story is the result of an ongoing problem in the trucking industry. An ongoing problem in Trucking Murder on the Dock, The Thomas Hartman Story. Many truck drivers every day will get into heated arguments on docks all across America. Whether it be at a shipper or receiver truckers are in a hurry to either get loaded or unloaded, in able to put miles behind them. A trucker relies on the wheels turning out many miles in order to make a decent pay check. When a trucker is held up at a shipper or receiver they can get very impatient and the results can get out of hand. Also, a dock worker at a receiver or a shipper also has pressures. They are held accountable for loading and unloading trucks all day and night long. If a dock worker slacks in their work, a carrier in many instances will charge detention time, resulting in less profits for the warehouse. Saunders was in law enforcement for 28 years. He made Sargent in 2001 and retired in 2017. In may of 2019 he backed into a dock at American Freight Furniture and Mattress on Highway 64 a few hours earlier than his appointment time. He was told that there were drivers that had an earlier appointment than he. An argument ensued and the result was a dock manager being shot between the eyes. Trucker Booting Scam - Know The Law. All across the country there is a new scam going on. Tow companies are setting up illegal booting traps. Unaware to the property owner, illegal tow companies will set signs on parking lots that say "No Semi Truck Parking". In many cases the signs are hidden and not well lit. When an unsuspecting trucker pulls in to the empty parking lot for a few hours of rest, the trap is sprung. Many time the signs might be quickly installed after the trucker has already laid down for some sleep. Then comes the knock on the door and the tired truck driver is awaken to a boot or a barnacle attached to his semi-truck. The ransom to free your rig Now comes the cost to get your truck back. These fees are very high and most truckers can not afford to pay the tow truck driver. These fees can cost up to $2500 just to have the boot removed. This is a scam and is very illegal. Know the law Being this is a new scam for the past couple of years, laws and those that enforce the laws are not always clear on what to do. The first thing you should know if that the tow company if acting in a legal manor will have a contract with the property owner. The signs will also display the name of the two company that is suppose to be monitoring the property. If the tow company can not show the legal paper work authorizing them to boot your rig, then they are most likely not in contract and you have been caught in a scam. Keeping a copy of the law in your truck will also help you especially if you call the police. Be prepared! How to avoid these scams You cant avoid every scam but here are some tips to avoid these illegal tow companies. The first and foremost step would be to avoid any parking lot that has a sign that states "No Semi trucks". Even if you suspect the tow company does not have a right to enforce it, you might think twice about pulling onto that property. Getting booted by someone that is not allowed to being doing so will create much aggravation and loss of time that it is not worth it. The latest trucker to kill an innocent driver on the road while under the influence happened this past week. Court records say Peterson Black, of Taylorsville, Utah, had been under the influence of alcohol Sunday while driving west on I-80, about 4 miles southwest of Grand Island. According to reports Black lost control of his truck and it crossed into the eastbound lanes, where a small sport utility vehicle went under the trailer he was hauling.  Recently another Drunk Driver This comes on the heels of another story of a dump truck operator who killed six people while driving drunk. Jamie Don McKenzie, 42, of Heber City, pleaded guilty this past April to three counts of automobile homicide, a second-degree felony, for his involvement in an October crash. There were too many trucking companies that went out of business in 2019 to count. Citing lack of fright because of trade wars, many carriers found themselves searching for freight. With lack of freight came lower rates and from there they started tumbling. Celadon Trucking was the largest but they issues went far beyond lack of freight!. Celadon was founded in 1985 by Steve Russell, a former executive with Ford, RCA and Hertz Truck and Equipment. It began with 50 leased trucks and 100 leased trailers. It became one of the first U.S.-based companies to forge routes into Mexico. Arrested Two former top executives at Indianapolis-based trucking and transportation company Celadon Group Inc.were indicted for their roles in an alleged fraud scheme that federal prosecutors say cost the publicly traded company's shareholders more than $60 million. Former Chief Operating Officer William Eric Meek, 39, and Chief Financial Officer Bobby Lee Peavler, 40, were arrested on nine counts each that include conspiracy to commit wire and securities fraud and conspiracy to make false statements to the company's accountants and falsify records. Peavler also is charged with two additional counts of making false statements to the company's accountants. This would obviously be part of their downfall. Driving a tractor-trailer for a living for most is a job but for some a dream. A young boy worked in his grandfathers garage greasing rigs and changing tires. Traveling up and down the highways in Pennsylvania in his pap's cabover, he fell in love with trucking! He would go onto learn many things from that old man. Respect, skills and safety would top the list. Howard "Jute" Heffner was his that old mans name and he was more than a grandfather. He thought this young man all he could and made such an impact in his life that most of that young boy knowledge would be credited to Jute. When he was 15 years old his grandfather would teach him how to shift a pick-up truck. The shifter was on the steering column. It was called a three speed and its nickname was "three speed on the tree"! He would go on to teach him how to shift them semi trucks too. Jutes Death and Memory Howard would pass-on when that young boy became a man leaving a great impact in his life. The young boy had become a man and Jute was no longer there to guide him. He would now have to make his name in the trucking world as his grandfather had done. The young man would go on to drive tractor-trailer for a living, traveling the interstates throughout the lower 48 states and Canada. He would work in the casket and reefer industry learning, now by experience. Never forgetting that old man that had given everything to make sure that he would become a man fit to be called Jutes grandson. The Trucking Industry Trucking A Young Boy's Dream. If your dream is to be a trucker, you will be great. Trucking is a lifestyle and those that dream of it, are always great at it. For this young boy, a dream fulfilled. He would go on to drive a tractor-trailer for many years and then work with other truck drivers in an office. He would then go on to work in the industry in many aspects helping and promoting truckers in a positive manor. A dream completed. Schedules are probably in the top 5 things that will always be different from the rest of the world. Birthdays and holidays can become a problem for OTR and Regional truck drivers. Sometime a driver has to make priorities in their lives. A driver must explain to his family his schedule. A good trucker family will understand the way our birthdays and holidays are going to be. A truck driver will have to decide many times which is more important. If we constantly choose to be home for every holiday and birthday off schedule we will lose allot of money. One must decide which is more important. Paying the bills and making sure college is take care of should be more important to a driver. In the long run it would be better to have a house paid for and educated kids rather than a grown man that can look back and say "My Dady alway made it home for my birthday". we were broke and thrown out of man y places but we never missed birthdays. Is there a law that covers this? Recently TalkCDL broke a story about a driver that was fired and was caught with alcohol in his cab. A carrier reported that the driver in question was terminated because of service failures. In fact 5 failures in the two week period he was with the company. Upon termination the carrier entered into his tractor, only to discover a couple of six packs. If we are putting two and two together we might come up with the reason for the great amount of service failures. Alcohol Inside Semi TrucksCompany Rules. If a driver signs paper work stating he will follow all company rules, he has nothing to stand on if he is fired for breaking the rules. When signing up with a carrier you might want to read up on their does and don'ts. Most carriers will have certain rules prohibiting the possession of alcohol in their trucks. You may not like it but a carrier is in they right to make such rules. It is no different than a mall or any public building that is owned by a business to reserve the right to prohibit or allow alcohol on their property (along with permits to do so). A trucking com[any is well with in their right to make such rules. DOT Rules The following rules are from the DOT. 6.3.2 Alcohol (392.5) Drivers are forbidden to consume or be under the influence of alcohol (as defined in 49 CFR 382.107) within four hours of going on duty or operating a CMV (49 CFR 392.5). Drivers are forbidden to use alcohol, be under the influence of alcohol, or have any measured alcohol concentration, while on duty, or operating, or in physical control of a commercial motor vehicle. He is now suing Florida-based Just Brands USA in Illinois District Court. In the suit, Darrow argues that Just Brands USA violated the Illinois Consumer Fraud and Deceptive Trade Practices Act by labelling their CBD products “No THC” when he says that they do in fact contain THC. Darrow ultimately was terminated from his employer and was out of work for several months. The US DOT is looking for past military personnel that are interested in driving a tractor trailer for a living. This is the first step to allowing under 21 year olds to obtain a Class A CDL and cross state lines. In this weeks podcast, Ruthann suggested that s program that allows drivers to start off with regional type driving would make a great program. Troy agreed with this suggestion and added that a radius depending on the state would make sense. Fro example if a driver lives in Maryland, he/she could driver into PA, DE, NJ, VA and WV. Ruthann and Troy agreed that one year of this kind of driving should get a young trucker ready to run all 48 states. Are you telling me you don't remember the Storie of Goldilocks and the three bears? Remember how Goldi wondered into their cabin and ate their food! But she did not eat everyones bowl. She first tried Poppa bears and it was too hot and then momma bears was too cold. She then went on and tried baby bears and it was just right. Well the moral of that story was, every thing Goldi did or tried was barley ever good enough for her. She in fact had to have everything just right, she never excepted anything that wasn't perfect for her. Well the problem with this kind of attitude, is, its all about her only. Goldilocks Truckers When a trucking company hires a "Goldilocks Trucker" they are getting someone that has to have it their way only. This means "Goldi" does not drive in certain areas, He has to be home at certain times, he has to have a specific truck and if Goldi gets offended in any way he is going to quit, or at least threaten to quit. Why is this an important issue? Well if a trucking company hires lets say one hundred drivers in a year. Let's say 10 of this drivers are "Goldilocks Drivers". So now we have ninety drivers that cooperate and get the job done with no belly-aching. Now take the 10 "Goldilocks drivers". They all have "special needs". So for example instead of taking the first load that pops up like one of the ninety drivers would have done, Goldi refuses the load. So now dispatch will need to put in more time (which costs money) to accommodate Goldi. This might sound like minimal effort but multiply this by ten every day and the 10 Goldi drivers become more work than the ninety drivers. I'm sure you get the point. Advice to Carriers Start paying your drivers what they are worth. I don't have the perfect plan but here is an example. A driver is worth what they bring to the table. For example a driver that had ten years of experience with a clean record is worth more than a driver with six months experience that had moving violations and a couple of accidents. Why? Because a driver with experience first of all will statistically not cost the company money with little incidents. That driver most of the times will not damage the truck or drive a carriers insurance rates up. Therefore the experienced driver is a more profitable hire. So pay that driver what he is worth and pay the driver that is not worth as much their due money also. Another example is the Goldilocks Driver. "Goldi" is never as profitable as a driver that is a team player. So, if the "Goldilocks Driver" has ten years of experience and you have a driver that has only one year of experience you have two drivers that might be more equal and the lesser experienced driver with a clean record is worth more than the ten year driver. It all comes down to safety and profitability. Like I said, I dont have the perfect plan but I think you get the idea. Your plan will have to be customized to fit your company. I would however tell you this. If you have a driver that brings a great record and attitude to the table, you should be rewarding that driver with top industry pay. If you have a driver that has a clean record and they stay out on the road as long as you need them and they will take any load anywhere, you should be ashamed if you are underpaying that driver. In fact if that driver quits and goes to another carrier, you then deserve to lose that driver. So stop up to the plate and start paying the driver what he/she is worth.
