Don't forget to stop by KoreanClass101.com for more great Korean Language Learning Resources! -------Lesson Dialog------- ----Korean---- 연명의료결정법이 2018년 2월 4일부터 전면 시행되기로 결정된 가운데 보건복지부는 2017년 10월 23일부터 2018년 1월15일까지 시범사업을 실시한다고 발표했습니다. 논란이 거듭 되어온 연명의료결정법이란 무엇일까요? 회생가능성이 없는 환자가 자기의 결정이나 가족의 동의로 연명치료를 받지 않을 수 있도록 하는 법으로서, 정식 명칭은 "호스피스, 완화의료 및 임종과정에 있는 환자의 연명의료 결정에 관한 법률"입니다. "불필요한 연명의료를 받고 있는 분들에게 품위를 갖추고 생을 마감할 수 있도록 하기위한 절차"를 다루는 법률이기에 이른바 존엄사법으로 명명되기도 합니다. 연명의료는 치료효과 없이 임종 기간만 연장하는 의학적 시술을 의미하며, 현재 본 법률상에서는 심폐소생술, 혈액투석, 항암제 그리고 인공호흡기 착용, 이렇게 네 종류로 명시되어 있습니다. 그렇기 때문에 연명의료 중단을 의미하는 존엄사는 사망시기를 앞당기는 안락사(조력 자살)와 확연한 차이를 둡니다. 이와 같은 존엄사법이 통과되기까지의 과정을 거슬러 올라가보면 본 법률의 초석을 다진 2009년 김할머니 사건을 마주하게 됩니다. 사건의 발달은 이러합니다. 식물인간 상태였던 김할머니는 치료 가능성이 없었고 가족들은 할머니의 품위있는 죽음을 위해 무의미한 연명 치료를 중단할 것을 병원 측에 요청했습니다. 그러나 병원측은 이를 거절하였고 그에 따라 가족들은 병원을 상대로 소송을 제기하였습니다. 이에 2009년 대법원은 "환자가 인간으로서의 존엄과 가치 및 행복추구권에 기초하여 자기결정권을 행사하는 것으로 인정되는 경우에는 특별한 사정이 없는 한 연명치료중단이 허용 될 수 있다"는 판결을 내렸습니다. 이와 같은 판례는 내년 2월부터 본격적으로 시행될 연명의료결정법의 발판이 되었습니다. ----English---- The Life-sustaining Treatment Determination Act will take effect from February 4th of 2018, and the Ministry of Health and Welfare announced that the corresponding demonstration and implementation project will begin from October 23, 2017 until January 15, 2018. What is the Life-sustaining Treatment Determination Act, which has been such a controversial issue over the years? This is a law that allows patients without any possibility of recovery (or their family) to decide not to continue with life-sustaining treatment for a patient. Its full title is "The Life-sustaining Treatment Determination Act for Near-death Patients Under Hospice and Palliative Care." This law is also referred as the "Death with Dignity Act," because it deals with procedures that allow patients who are receiving life-sustaining treatment to face their deaths with dignity. Life-sustaining treatment is defined as medical treatment with the purpose of delaying death, but which does not improve patients' condition. Cardiopulmonary resuscitation, hemodialysis, chemotherapy, and ventilator treatment are the four types of treatment mentioned in the Life-sustaining Treatment Determination Act. So there is a stark contrast between life-sustaining treatment termination and euthanasia (assisted suicide), which denotes the practice of intentionally ending a life. When we look back to the events that led to passing of the Law, there is a fundamental incident which laid the foundation of this law - Ms. Kim's 2009 Case. This is how the case developed. Ms. Kim was in coma and had no possibility of recovery, so her family requested the hospital to discontinue her life-sustaining treatment, which they considered pointless. However, the hospital rejected their request, and Ms. Kim's family sued the hospital. In 2009, the Supreme Court ruled in favor of Ms. Kim's family with this significant remark: "Life-sustaining treatment can be discontinued if it is approved that such decision is made by a patient on the basis of human dignity and worth and the right to pursue happiness, except under special circumstances." Since withdrawing from the Nonproliferation Treaty (NPT) in 1993, North Korea had implemented five rounds of nuclear weapons tests. Staring with its initial test in 2006 and continuing until recently, its fifth round in September 2016, such experiments by North Korea raised security concerns within the international community. September 3rd's sixth round of nuclear tests and North Korea's announcement at the 72nd UN General Assembly that it has no intention to stop its experiments resulted in the international community strengthening its stance to increase pressure against North Korea. South Korean President Moon Jae-In stressed his ""no war within the Korean Peninsula"" policy, citing that the nuclear issue should be resolved peacefully through multilateral communication. China also strongly reprimanded North Korea's nuclear experiment, stating that the Chinese government ""absolutely believes in a nuclear weapon free Korean peninsula, nuclear nonproliferation, and maintaining peace in Northeastern Asia,"" adding, ""North Korea has ignored the international community's widespread opposition by carrying out nuclear tests."" In addition to these statements, China added weight to the pressure on North Korea. Local government officials in the border city of Dandong, which boasts prolific trade with North Korea, ordered local companies to send back North Korean laborers, warning that hiring new North Korean employees would result in a fine of 5,000 yuan (approximately 860,000 KRW). However, it is the stance taken by the United States on the North Korean nuclear issue that is becoming the center of attention, with the heated debate that took place between US president Donald Trump and North Korea, maximizing tensions surrounding the Korean peninsula. President Trump claimed that diplomatic efforts with North Korea were useless, stating that for the past 25 years, US presidents have tried diplomatic talks with North Korea and offered massive financial support, but that North Korea violated the agreements before the ink was dry on the agreements.
