This week our topic is the proposed law to suspend all mining activity in the country for the time being. The report has been prepared by the University of Maine in collaboration with Radio Sumpul and US-El Salvador Sister Cities. Los Ministerios de Economía (MINEC) y de Medio Ambiente (MARN) presentaron a la Asamblea Legislativa un anteproyecto de ley que suspendería la actividad minera en el país, sea de exploración o de explotación. La “Ley Especial para la Suspensión de los Procedimientos Administrativos Relacionados a Proyectos de Exploración y Explotación de Minería Metálica”, aplazaría todas las obras a causa de la vulnerabilidad ambiental y social en el país, y debido a la “débil” institucionalidad para regular la extracción de metales. El ministro de Medio Ambiente, Herman Rosa Chávez, explicó que la ley suspendería todos los procesos administrativos activos, analizados por el Ejecutivo. En el MARN hay 18 estudios de impacto ambiental de exploración minera, mientras que en el MINEC hay 12 solicitudes de prórroga y se han recibido 9 peticiones nuevas de exploración. El anteproyecto de ley requiere la creación de un comité de seguimiento que verifique periódicamente las condiciones ambientales y sociales para levantar o no la suspensión de la actividad minera en el territorio. El ministro de Economía, Armando Flores, aseguró que el anteproyecto le daría al Estado y al pueblo “el tiempo prudencial” para aplicar todas las medidas relacionadas con la actividad minera. El documento, entregado al presidente de la Asamblea, Sigfrido Reyes, se basa en la evaluación ambiental estratégica del sector minero metálico de El Salvador, e indica que la vulnerabilidad en el territorio es una barrera para garantizar el control de los riesgos de la minería metálica. La evaluación ambiental estratégica también aconseja que en la exploración y explotación minería en El Salvador, se aplique la máxima precaución. El Gobierno cree que el anteproyecto de ley no afectará la inversión nacional y extranjera, sino que podrá crear mayor certidumbre para los empresarios. Según el ministro Flores, las empresas nacionales e internacionales que quieran invertir en el país en la extracción de metales preciosos tendrán mayor claridad de cómo hacerlo. El ministro del MARN, por su parte, afirma que el anteproyecto es un componente de la construcción de la política nacional de medio ambiente. Parte de la política es que ambos ministerios formularán un plan de fortalecimiento para organizar, supervisar, promover e implementar acciones que permitan cumplir un mandamiento para reducir la vulnerabilidad del país ante la minería. Actualmente, MINEC no tiene los recursos económicos de inversión que requieren los proyectos mineros, porque varios no cuentan con permiso ambiental, documento obligatorio para determinar un presupuesto. El comité de seguimiento: • Estará formado por los ministros de Medio Ambiente y Economía, el procurador de derechos humanos, un representante de la Secretaría Técnica, dos representantes del sector privado empresarial; dos de la sociedad civil y dos expertos internacionales. • Estudiará las condiciones del país para levantar o no la suspensión de los permisos de exploración y explotación minera. • La decisión contará con la aprobación de al menos siete de los miembros del comité. • Después de votar, el Órgano Ejecutivo, a través de los ministerios de Economía y Ambiente, le informará a la Asamblea Legislativa sobre el levantamiento de la suspensión temporal.
