[Cross-posted from New Books in Big Ideas] A friend of mine who had just graduated from law school said “Law school is great. The trouble is that when you are done you’re a lawyer.” Steven J. Harper would, after a fashion, agree (though he would probably add that law schools are not that great). Harper’s book, The Lawyer Bubble: A Profession in Crisis (Basic Books, 2013), is a stem-to-stern indictment of legal education and the legal profession; he argues that the entire system by which we train and employ (or don’t employ) attorneys is broken. Honesty, humility, and public service are out; “truthiness,” hubris, and greed are in. The very idea of what it means to be a lawyer has been corrupted. Happily, Harper has some suggestions about how we might reform the legal industry. This is a terrific and thought provoking book.

[Cross-posted from New Books in Biography] Forty years after its debut, The Mary Tyler Moore Show remains one of the most beloved and successful television sitcoms of all time. But Jennifer Keishin Armstrong‘s Mary and Lou and Rhoda and Ted: And all the Brilliant Minds Who Made The Mary Tyler Moore Show a Classic (Simon & Schuster, 2013) isn’t a simple episode recap. Rather, it’s a deep excavation of the show’s history from the perspective of the cas came t, the producers, a fan, and- perhaps most fascinating- the writers. You might ask, How is this biography? It is because, ultimately, Armstrong is writing about lives- the lives of the people involved in the show, the lives from which they pulled their material, and how their lives together, often haphazardly, to produce extraordinary TV. The Mary Tyler Moore Show depicted a woman’s work life, so it’s not too surprising that Mary and Lou and Rhoda and Ted does the same. However, the workplace that emerges is a revelation: with men recognizing the value of women’s stories and actively seeking women for the writing staff; with women writers mining their own lives for material and producing scripts that incorporate the everyday experiences of women, which were- at that time- seldom represented on TV. We remember The Mary Tyler Moore Show because it was well-crafted and funny. But, as Mary and Lou and Rhoda and Ted reminds us, the show came about in an environment that promoted equality and where the gifts of women were encouraged. Such environments are, sadly, still rare.

[Cross-posted from New Books in Pop Music] Extreme metal, punk, and hardcore. Slayer. Sick of it All. Cro-Mags. Decapitated. Behemoth. Musically aggressive rock bands with growling vocals and lyrics about annihilation, death, and dismemberment. A genre of music that, even more than more mainstream music genres, seems to be the province of (straight) white males. But wait. In What are You Doing Here?: A Black Woman’s Life and Liberation in Heavy Metal (Bazillion Points, 2012), Laina Dawes examines an overlooked and numerically small segment of the extreme music scene: black women. Putting her sociological training to good use, Dawes presents a macro structural cultural analysis of race in North America (Dawes is Canadian) and how this plays out in the micro-arenas of high school community and heavy metal shows. Using in-depth interviews with a number of black women punk and metal artists including Skin, Sandra St. Victor, Militia Vox, Diamond Rowe, Urith Myree, Tamar-Kali, Ashley Greenwood, Yvonne Ducksworth, Camille Douglas, Alexis Brown, and others, Dawes highlights the self and societal contradictions of being black, female, and a fan of extreme music. Most significantly, the black friends of these women accuse them of not being black enough and their white metal friends (and strangers, for that matter) are dumbfounded about what a black woman might find interesting in this world of white males. The answer to both, writes Dawes, is easy: Metal fandom allows these women to be themselves, to be individuals, to escape the narrow confines of prescribed gender and race roles in North American society. Laina Dawes is a music and cultural critic and opinion writer, an active public speaker, and a contributor to CBC Radio. She is also a current affairs columnist for Afrotoronto.com and contributing editor for Blogher.com.

[Cross-posted from New Books in Law] Every hundred years or so, the Supreme Court decides a question with truly vast economic implications. In 2012 such a decision was handed down, in a case that had the potential to affect the economy in the near term more than any court case ever had. The substance of the case, and its lasting legal implications, are the subject of Andrew Koppelman’s The Tough Luck Constitution and the Assault on Health Care Reform (Oxford University Press, 2012). The plaintiffs in the “Obamacare” case, NFIB v. Sebelius, had political and legal goals. Politically, they failed, because Justice Roberts was not willing to undo the huge Congressional effort to reform the country’s health-insurance system. But legally, in terms of doctrine, the litigation was a smashing success, altering principles that reach back hundreds of years. Andrew Koppelman has written a superb layman’s guide to what was at stake, legally, in last year’s case — and what the plaintiffs accomplished. They persuaded five justices of the Supreme Court to call into question both of the Court’s most economically significant previous decisions, one from the early days of the Republic, and one from the New Deal. In 1819, the Court agreed unanimously that the federal government could solve national problems: “Let the end be legitimate, let it be within the scope of the constitution, and all means which are appropriate, which are plainly adopted to that end, which are not prohibited, but consist with the letter and spirit of the constitution, are constitutional.” (James Marshall) In 1935, the vote on a similar question was five to four: ”Although activities may be intrastate in character when separately considered, if they have such a close and substantial relation to interstate commerce that their control is essential or appropriate to protect that commerce from burdens and obstructions, Congress cannot be denied the power to exercise that control.” (Charles Evan Hughes) But the dissent in 1935 took a very different view, one that resonates with the conservative voices of 2012: “The right to contract is fundamental, and includes the privilege of selecting those with whom one is willing to assume contractual relations.” (James McReynolds) In 2012, the Court is now split 4-5, in the other direction, on both of these topics. Prof. Koppelman shows that the “necessary & proper” clause, held to trump states’ rights by Justice Marshall, is hollowed out by Justice Roberts’ opinion. And Justice McReynolds’ “right to contract,” made infamous by the Lochner court, has returned in ghostly form, as a new individual right not to contract with insurance companies. In economic matters, the tide of constitutional law is shifting. The power of the Tough Luck constitutional doctrine was not exercised because of Justice Roberts’ forbearance in preserving the Affordable Care Act on other grounds. But with the help of Prof. Koppelman’s lucid and persuasive book, any reader can now fully grasp the legal significance of this line of thinking. Its practical implications, meanwhile, are becoming visible in the context of Medicaid, because a secondary holding in the case empowered governors to refuse new federal money for health care for the working poor.

[Cross-posted from New Books in Political Science] Cyril Ghosh is Visiting Assistant Professor at Wagner College where he teaches courses in American government, political theory, and immigration. His new book, The Politics of the American Dream: Democratic Inclusion in Contemporary American Political Culture (Palgrave-MacMillan 2013), explores the development and meaning of this powerful national myth. Ghosh tracks the historical development of the American Dream and answers important questions about its conflicted meaning in contemporary politics. Candidates for public office often evoke the American dream, but Ghosh argues that these evocations are rarely consistent and the definitions often in conflict with each other. Ghosh is an enthusiastic author. His prose reflects an eagerness to share what he has learned, resulting in an enjoyable and accessible read.

 Richard Rashke, “Useful Enemies: John Demjanjuk and America’s Open-Door Policy for Nazi War Criminals” | File Type: audio/mpeg | Duration: 1:18:00

[Cross-posted from New Books in History] You may have heard of a fellow named Ivan or John Demjanuik. He made the news–repeatedly over a 30 year period– because he was, as many people probably remember, a Nazi war criminal nick-named “Ivan the Terrible” for his brutal treatment of Jews (and others) in the Sobibor death camp. The trouble is, as Richard Rashke points out in his new book Useful Enemies: John Demjanjuk and America’s Open-Door Policy for Nazi War Criminals (Delphinium, 2013), Demjanuik was not a Nazi, was not “Ivan the Terrible,” and, though he was certainly a guard at Sobibor, it’s not entirely clear what he did (though it was likely very bad). Again and again he was brought to trial for his alleged crimes. Again and again the courts failed to agree on what he had done. Demjaniuk was and remains something of a mystery, a vital mystery that we badly want to solve but cannot. After all, we need to know who is a war criminal and who is not. What’s most interesting about Demjaniuk–at least to this reader–is the moral complexity of his story. As Rashke shows, he was repeatedly compelled to make life and death choices as he tried to stay survive in Stalinist Russia, in Nazi-occupied Eastern Europe, and even after the war. He had options, but they were almost always bad ones, and often deadly ones. He was a “collaborator” to be sure. But, Rashke asks, what exactly is a “collaborator”? Could he have chosen differently and hoped to survive? Could he have acted “morally” in the context within which he found himself? Rashke says “yes.” Listen in and find out why.

[Cross-posted from New Books in African American Studies] German military theorist Carl Von Clausewitz observed that many of the important variables in war exist in ‘clouds of great uncertainty’ which create disconnects and confusion that persist even after the fighting has ended. The conflict between the Black Panther Party and the United States government is in ways illustrative of this phenomenon–or ‘the fog of war’ as it has come to be called–and helps explain why the Party is so well known yet misunderstood. For many, the Black Panther Party exists in image fragments: bullet-pocked storefronts, raised fists, drawings of mutant-pig policemen, Huey P. Newton on a wicker throne. For others, it exists in biographies of its leaders: Revolutionary Suicide, Seize the Time, This Side of Glory, A Taste of Power, just to name a few. Historians and political theorists have weighed in as well exploring the excesses of COINTELPRO, the failures of party leaders, gender inequity, missed opportunities, failed alliances, and endless betrayals. Yet there is still much to learn. In Black Against Empire: The History and Politics of the Black Panther Party (University of California Press, 2013),  authors Joshua Bloom and Waldo Martin do an excellent job of putting the movement in its historical and philosophical context as not merely a challenge to American racism, but to American empire. [Cross-posted from New Books in Big Ideas] Most people think that professors are more liberal, and some much more liberal, than ordinary folk. As Neil Gross shows in his eye-opening Why are Professors Liberal and Why do Conservatives Care? (Harvard UP, 2013), “most people” are right: academia is much more left-leaning than any other major profession in the U.S . But why is this so? As Gross points out, there are a lot of “folk” explanations out there, but none of them holds much water. Gross looks the data (a lot of which he collected himself) and searches for a more compelling explanation. It’s surprising: the fact that most college students think professors are liberal (which is true) makes those among them who are conservative think they wil not be welcomed in the profession (which, as it turns out, may not be true). By analogy, men don’t generally become nurses because they think of nursing as a “female” profession. Just so, conservatives don’t become professors because they think of academia as a “liberal” profession. But does it matter that academia is liberal? Listen in and find out.

[Cross-posted from New Books in Jazz] Feed: “How do I get to Carnegie Hall?” Comic:  “Practice!” When I first began to build a jazz record library back in the early 1960s, one particular album stood out.  A rare “double-album,” Benny Goodman’s Famous 1938 Carnegie Hall Jazz Concert was more akin in appearance to the records in my parents’ classical record collection.  The back stories and analyses of the concert, the marketing of the recording 12 years later in 1950, and the subsequent canonization of the concert and recording is the story Catherine Tackley tells in her new book for the Oxford Studies in Recorded Jazz Series, Benny Goodman’s Famous 1938 Carnegie Hall Jazz Concert (Oxford University Press, 2011) Tackley is an extremely busy and talented woman.  An academic, musician, writer, teacher, and performer, she adores both the study of and playing jazz.  She played Goodman’s songs herself with her big band Dr. Jazz and the Cheshire cats “in a room full of the world’s leading jazz scholars.”  Now that’s academic courage! Benny Goodman, billed the “King of Swing,” was uneasy about the longevity of the label; a perfectionist and an artful player of both jazz and classical music, he feared that he’d be typecast.  His Carnegie Hall concert was “sold” by promoters at the time as an important event in the history of the evolution of jazz in general and swing in particular. Nonetheless, Tackley recounts how Carnegie Hall had been the site of both classical and popular music, with “crossover” antecedents to “jazz” concerts going back as far as 1912 when an integrated audience attended the Clef Club orchestra consisting of all black musicians who “played a program of traditional spirituals and compositions by black composers.”  And there were others, including Paul Whiteman’s orchestra and W.C. Handy featuring Fats Waller, all of whom played at Carnegie Hall before Goodman. Goodman and his band were already well known to the public due to his many live, nationally broadcast radio programs.  Tackley uses a musician’s and historian’s approach in analyzing the subtle differences in the arrangements and performances on the January 16, 1938 program.  She also tells interesting anecdotes about drummer Gene Krupa, trumpeter Harry James, vibe-player Lionel Hampton, pianist Jess Stacey and many others.  Members of Duke Ellington’s  and Count Basie’s bands also participated in the jam session that night, too.  Ironically, for the musicians who played that evening, it might have been just another working night.  After the concert many of the musicians went to the Savoy Ballroom to hear a battle of two other famous bands –Count Basie and Billie Holiday dueling it out with Chick Webb and Ella Fitzgerald! Finally, the author tells the story of the concert’s own creation myth when 12 years later, in 1950, the acetates from the concert were “found” and subsequently  marketed by Columbia Records.  Goodman, the critics, and the producers at Columbia thought the release might revive swing.  Jazz and Goodman had long moved on to other forms, but the concert on January 16, 1938 became part of jazz history nonetheless.  Tackley’s story of the concert, the individual song performances, the critical and audience responses, and the later marketing of the recording  gives the reader a fascinating glimpse at how the music that night became part of jazz’s and America’s cultural legacy. On a personal note, my wonderful father-in-law, who passed away in February, 2013, was a WWII veteran who adored big bands and the music of Benny Goodman.  I met Farris Sadak the first time when he and his wife Gamile were listening to a jazz quartet at the Ice House in Herndon, Virginia, in 1982.  Two of his friends were members of the quartet: one, Smitty, another WWII veteran, played clarinet; the other, drummer Brooks Tegler, patterned himself after Gene Krupa.  Nothing made my father-in-law happier and more nostalgic than tapping his foot whenever [...]

 Melissa R. Klapper, “Ballots, Babies, and Banners of Peace: American Jewish Women’s Activism, 1890-1940″ | File Type: audio/mpeg | Duration: 0:56:07

[Cross-posted from New Books in History] Many people have probably heard of Betty Friedan, Bela Abzug, Gloria Steinem, and Andrea Dworkin, all stars of Second Wave Feminism. They were also all Jewish (by heritage if not faith). As Melissa R. Klapper shows in her new book Ballots, Babies, and Banners of Peace: American Jewish Women’s Activism, 1890-1940 (New York University Press, 2013), this was no accident. Freidan et al. inherited a rich tradition Jewish women’s activism in the U.S. These women did not burn their bras (it’s not clear that any feminists did, actually), but they did fight for the vote, for birth control, and for peace. In this interview, Melissa explains why, how, and to what extent they succeeded.

[Cross-posted from New Books in Big Ideas] Is there an “American Empire?” A lot of people on the Left say “yes.” Actually, a lot of people on the Right say “yes” too. But Elizabeth Cobbs Hoffman says “no.” In her stimulating new treatment of the history of American foreign policy American Umpire (Harvard UP, 2013), Hoffman lays out the case that America have never been an “empire” in any real sense. Rather, she says America has been and (for better or worse) still is an “umpire,” making calls according to an evolving set of rules about what makes a legitimate state. She points out that not all of the calls have been good ones–Vietnam and Iraq II being the most obvious examples. Nonetheless, America has long served the world as a kind of fair broker. Whether America should continue in this role is, as she says, an open question. Listen in.

 James Wellman, Jr., “Rob Bell and A New American Christianity” | File Type: audio/mpeg | Duration: 1:03:23

[Cross-posted from New Books in Religion] As one of Time Magazine’s “100 Most Influential People in the World” Rob Bell is a name that is now known well beyond the confines of his megachurch in Grandville, Michigan or within evangelical circles. Bell has been at the forefront of contemporary Christian movements in America and is situated in a unique liminal space where he refuses to be defined. In a new book, Rob Bell and A New American Christianity (Abingdon Press, 2012), James Wellman, Jr.,  Associate Professor of Religion at the University of Washington, probes Bell’s life and examines how he can serve as a lens for understanding the shifting boundaries of the American religious landscape. For Wellman, the enthusiasm and success of congregations like Bell’s Mars Hill Church is indicative of the failure of fundamentalism in American Christianity. The refusal to be labeled by a particular interpretive framework reflects the growing American population’s self-identity as “nones.” This might be why many from the “Spiritual but not Religious” persuasion are attracted to Bell. In fact, after the publication of Bell’s most recent book, Love Wins (2011), he has been charged with being a universalist who is amending the gospel. So what does Rob Bell reveal about American religious culture? How is it changing? And where is it headed? In my conversation with Wellman, we discuss the role of performance, charisma, media, the artistry of the sermon, the relationship between the secular and sacred, gender inclusion, experience over belief, discipleship for here and now, and the importance of media competency.

[Cross-posted from New Books in Political Science] Daniel McCool, professor of political science at the University of Utah, is the editor of The Most Fundamental Right: Contrasting Perspectives on the Voting Rights Act (Indiana University Press, 2012). The VRA was one of the center pieces of the civil rights legislation passed in the 1960s. The Act aimed to address great inequities in access to and participation in voting, particularly among African Americans. Perhaps most controversially, the law labeled a handful of states that were deemed the most egregious violators of voting rights, and required them to gain pre-clearance from the Department of Justice on any changes in state voting procedures. Nearly fifty years later, is the case for the VRA still so pressing or are modifications or a complete overhaul called for? This timely collection provides deep theoretical and empirical justifications for the VRA, and equally well-developed arguments in opposition. One finished the collection more informed and a little unsure of what is called, both signs of a well-edited volume. The timeliness of this book cannot be overstated. On Wednesday February 26, 2013, the Supreme Court hears arguments in the Voting Rights case of Shelby County v Holder.

 John E. Murray, “The Charleston Orphan House: Children’s Lives in the First Public Orphanage in America” | File Type: audio/mpeg | Duration: 0:57:31

[Cross-posted from New Books in History] There were always and will always be orphans. The question is what to do with them. In his terrific new book The Charleston Orphan House: Children’s Lives in the First Public Orphanage in America (University of Chicago Press, 2013), economic historian John E. Murray tells us how one Southern American city did it in the 18th and 19th centuries. Charleston was a city divided between free whites and enslaved African Americans. The whites felt insecure and, according to Murray, this is one of the reasons they founded and funded America’s first public orphanage. The white-only institution not only helped indigent parents and their children, but it also brought the city’s white population together in a way no other body did.  It was an expression of civic humanity, but it was also an expression of white unity against the black masses. [Cross-posted from New Books in Native American Studies] Just east of the Norwich-New London Turnpike in Uncasville, Connecticut, stands the Mohegan Congregational Church. By most accounts, it’s little different than the thousands of white-steepled structures dotting the New England landscape: the same high-backed wooden chairs, high ceilings, images of lordly white men. To the careful observer, there is one notable distinction. Just above a traditional cross near the front entrance hangs a single, perfect eagle feather. The juxtaposition might be startling for some. But as Brown historian Linford D. Fisher beautifully illuminates in The Indian Great Awakening: Religion and the Shaping of Native Cultures in Early America (Oxford University Press, 2012), Native cultures in New England – and, indeed, most everywhere – are highly incorporative, blending elements of Christian religious practice with their own. This was never more the case than during the eighteenth century evangelical revival known to scholars as the First Great Awakening. A significant turning point in American spiritual life, Native peoples of New England are often left out of the narrative. When they’re included, it’s as passive targets of conversion. Fisher tells a dramatically different story. (Many thanks to New Books in American Studies host Benjamin Smith for composing our new intro music!)
