Unbelievable but true. The case of “International Franchise Association vs. City of Seattle” is now being heard in the U.S. Court of Appeals for the Ninth Circuit. The franchisers are claiming that a living wage violates their Equal Protection Clause of the 14th Amendment to the U.S. Constitution. The members of the International Franchise Association claim the city of Seattle showed “animus” – or hostility – to corporations because the law goes after corporations as a disfavored minority. That means corporations think their civil liberties are being violated just like ex-slaves of the 19th century. It sounds surreal but the International Franchise Association with outside financial assistance has hired conservative corporate lawyer Paul Clements who is famous for arguing cases before the Supreme Court. It’s a country gone mad. Listen and understand the insanity. "A Cup of Joe" sits in for Egberto Willies on Politics Done Right Saturday and is joind by Former Kansas Gubernatorial Candidate Jennifer Winn as they go down the Jury Nullification road. A sanctioned doctrine of trial proceedings wherein members of a jury disregard either the evidence presented or the instructions of the judge in order to reach a verdict based upon their own consciences. It espouses the concept that jurors should be the judges of both law and fact. The traditional approach in U.S. court systems is for jurors to be the "triers of fact," while the judge is considered the interpreter of law and the one who will instruct the jury on the applicable law. Jury nullification occurs when a jury substitutes its own interpretation of the law and/or disregards the law entirely in reaching a verdict. The most widely accepted understanding of jury nullification by the courts is one that acknowledges the power but not the right of a juror or jury to nullify the law. Jury nullification is most often, although rarely, exercised in criminal trials but technically is applicable to civil trials as well, where it is subject to civil procedural remedies such as the Judgment Notwithstanding the Verdict. In criminal cases, however, the Fifth Amendment to the U.S. Constitution makes final a jury trial that results in an acquittal, and it guarantees freedom from Double Jeopardy. This gives juries an inherent power to follow their own consciences in reaching a verdict, notwithstanding jury instructions or charges to the contrary. Many in Congress want to lower taxes for the rich because (they say) the rich or over-taxed. Meanwhile, they are also trying to get the poor to pay more taxes because we’re getting a “free ride”. When you add up all the regressive taxes that fall disproportionately on the poor – things like social security and sales taxes – and then you subtract the tax breaks for capital gains and dividends for the rich, well, then percentage of incomes paid for taxes are pretty darn close. What’s also surprising is that self-employed individuals pay the highest combined rate for taxes. So much for all that talk about entrepreneurial America. Also, hear why Rand Paul’s idea for a flat 14.5% income tax is a bad deal for everybody in America except the very wealthy. Thursday afternoon a jury acquitted Kyler Carriker of Felony Murder.  The verdict ended a fight for justice that was two years old and reached across the country with attorney, activists & journalists all pitching in, joined by a community of supporters that never wavered from the fight. It was wonderful to watch and more wonderful to be a part of. Sunday Morning we spend time with a few of the important people who waged that fight.  Mike Shatz of Kansas Exposed, Meko Haze of The Daily Haze and Joe Grumbine of The Human Solution International join me to discuss the trial, the issues, the protestors and how much more work there is for everyone to do. Mike, Meko and Joe provided a window into the trial process reporting on testimony, rulings by Judge Pullman and the strategy of the Prosecuting Attorney.  Along with Jennifer Winn, Kyler's mother, providing daily video updates, these three and people like Shona Banda, Kisty Watson and even Mike Harris on social media, showed the world how unity works in a fight for justice and how Kyler and marvelous attorney Sarah Swain knew at all times that there were many fighting with them.  It will be an inspiring conversation.  So grab a cup of coffee and join us Sunday Morning for this important discussion. Afew nights ago Bernie Sanders had house parties throughout the country. Over 100,000 people signed up. I went to one in the role of a blogger and was blown away by the group of people attending. Bernie Sanders has been accused of having supporters that do not reflect the demographics of America. It seems like the Black Lives Matter protest at Netroots Nation 2015 has completely changed the character of his campaign operation. This particular Bernie Sanders house party did not only reflect America, it reflected Houston, it reflected Texas. Moreover the stream beamed into homes throughout the country was also very diverse. Bernie Sanders has not changed his message. He enhanced it. He made it more reflective. He made it more inclusive. Currently the polls still show Hillary Clinton with a substantial lead. It also shows Bernie Sanders constantly chipping away. I have been to Netroots Nation in five consecutive years. Netroots Nation is the largest conference of Liberal bloggers, writers, politicians, and organizations in the country. Every year panels are held to educate, strategize, inform, and network. Politicians abound as they seek to enlarge their political footprint. Netroots Nation has been eventful every single time. We’ve had protest actions in Detroit about water shutoffs and emergency managers, as well as actions in Providence, Minneapolis, San Jose, and beyond. We have had protests and actions to support our immigrant brothers and sisters. We have even challenged presidential candidates vociferously. Netroots Nation 2015 was different. The passion of the disruption effected by the Black Lives Matter movement led by Patrisse Cullors and other local activists including one from Houston was monumental. It was disruptive. It caught Netroots, Bernie Sanders, and Martin O’Malley off guard. And that was their intent. Their is an existential problem for many of our brothers and sisters of color that for the most part has been ignored and or misunderstood. After that action, the problem is now in the forefront. We talk to Patrisse Cullors and discuss Sandra Bland's death.

Just over three years ago this show was launched with an interview with Larry Lessig as he discussed his then new book, Republic Lost.  As we enter year four it is time to spend a little time talking about this broadcast: where we have been; where we are going; and what we need to do to get there.  For example, Lunch with Louden has embraced the concepts: that Civility and Reason can melt away the false arguments that create “us and them”; that Liberty and Justice are not natural companions, but a brilliant opportunity to use the creative tension they generate together “in order to create a more perfect union”; that Money in Politics is the key stone barrier to “government by and for the people”; that, more than anything, we are more alike than different; and, that when we come together we can spark American Ingenuity, the magic that really can find new solutions to new challenges made to appear to be unsolvable.
