Coming up on today’s edition of the Utah Real Estate Podcast we’re going to be talking about home inspections and why they are required. Joining me for the podcast is Greg Hales, the Commercial Real Estate Manager at Weichert realtors at the Rockies. Good morning. Greg Hales: Good morning. Patrick Wiscombe: Yesterday we talked about appraisals and why appraisals are so important to the whole process; essential really. Why does someone have to get a home inspection when buying or selling a piece of real estate? Greg Hales: I don’t think you can disclose too much when you are selling a piece of property. We live in a litigious society. We want to make sure when we buy or sell something that everybody knows exactly what we are buying. If I were to sell you something, I want you to know everything about it. That’s basically what a home inspection is. It allows the buyer to know everything about the home that you know. For all of your listeners out there, I want to pass on a little bit of advice. Don’t be afraid to disclose the warts on your house. Everybody needs to make an informed decision. You don’t want to sell something and have someone have a letter from the law firm in your box thirty days after you sell the house because they didn’t know about it. Please take the time, expose it, and discuss it. This reminds me of a home we sold. We had a dishwasher line break and it flooded a lot of the upstairs and part of the downstairs. We go to sell it and on the inspection sheet it asks if we had any floods. The answer would be no, but in the box below I filled out, “Dishwasher line broke, caused water damage.” The inspector came back and said, “Whoa, this thing has had water damage!” Don’t be afraid to let those details come out. Subsequently we did sell the house because we were up front with them. Patrick Wiscombe: So just be completely honest? Greg Hales: Yes. The other thing that everybody gets nervous about on a home inspection is if they find something, they’re going to ask you to fix it. Mostly it is up to 500 dollars that you might be required to fix that thing in the house. At that point in time it’s up for negotiation. As an example, if the roof has got big holes in it and you’ve specified that there aren’t any, or as another example,

Coming up on today’s edition of the Utah Real Estate Podcast we’re going to be talking about things that are absolutely necessary to get your house sold; this includes the appraisal, the title report, and the home inspection. Joining me for the podcast, all the way from American Fork, Utah is Greg Hales, the Commercial Real Estate Manager at Weichert Realtors at the Rockies, hello there. Greg Hales: Good morning, how are you this morning? Patrick Wiscombe: Doing alright. Now I mentioned at the beginning of the podcast that there are three things that every piece of property needs to go through; the appraisal, the title report, and the home inspection. Let’s begin with the appraisal. Why is an appraisal necessary? Greg Hales: Well I think the appraisal is now becoming the top of everybody’s list. With so many short sales and modified sales in your neighborhood, sometimes you’re not going to get the appraisal you think. I want to tell all of your listeners out there to forget about what someone is selling their home for. That doesn’t have any bearing on an appraisal. You can go up and down the street and say I know the Jones’ are trying to sell for this or the Smiths’ are trying to sell for this, that doesn’t count. The only thing in an appraisal that would help your appraiser is what a home sold for. It’s the only thing of value that they can base it on and they will only use that in their report. Now, an appraisal will take in a number of things. It will take in your square footage, the size of your lot, the age, the condition, number of bedrooms, bathrooms, garages, RV pads, etc. Then they will get a property that is similar to your property and then make adjustments, either pluses or minuses. So many times people will say, “I know the Smiths’ sold for this.” If you know that, then it’s not public knowledge. You need to let your appraiser know that. The ability to create a value based on a professional opinion, which is what an appraiser does, is only available through what sales are or what a home sold for. Patrick Wiscombe: So the documented proof basically? Greg Hales: Absolutely! California and a number of other states, I don’t know for sure right now, they use what they call a non-disclosure state. You don’t have to disclose what your home sells for. California uses it because that changes their tax base every time a home sells.

Joining me for the podcast, as he does every single week day morning, Greg Hales, the Commercial Real Estate Manager at Weichert Realtors at the Rockies in American Fork. Hello there. Greg Hales: Good morning Patrick, how are you? Patrick Wiscombe: Good, let’s get right into this. Some of the things that people need to do in order to get their house sold; we are developing a checklist of items that people need to do in order to further the sale of their house and one of the things that people absolutely need to do is assist in scheduling all closing details. Now, what are the closing details and what kinds of things need to be scheduled? Greg Hales: As you sell your property, there is really a checklist as you go through them. You’ll have certain contingencies or things that have to occur before your house can close. Some of those would include an appraisal, property disclosure, financing deadlines, title report. Those are sort of the details that continue to keep your contract in place or not. If I could just take a minute, a word that a lot of people may be familiar with or not familiar with, or as they say, this is contingent upon. As you see that word or if it’s contingent upon those things, that becomes a checklist item for you and your realtor to take care of and that would include home inspections, appraisals, financing contingencies. These are the things that your realtor really has to stay on top of so the contract stays in full force in effect. Patrick Wiscombe: And if those things aren’t done, you could have a breach of contract correct? Greg Hales: You could. You could have a seller’s breach of contract which most guys really don’t think about, or you could have a buyer’s breach of contract. Either one of those could trigger a breach of contract, so essentially you’re really not selling your home because it’s not under contract. Patrick Wiscombe: Alright, and that’s obviously no place that anyone wants to be. Now, we also talk about delivering the executed documents to the party that’s involved. Why is that?
